Terms And Conditions

1 About these terms

These terms apply to your use of the MenXclusive website, ticket purchases, private events, individual or group performer hire, full-show bookings, Buy the Show packages, venue or promoter bookings and attendance at our events. Please read them together with our Privacy Policy and any booking details supplied before purchase.

“We”, “us” and “our” refer to Dream Events and Productions, trading as MenXclusive. “You” and “your” refer to the customer, website user, booking organiser or event attendee, as applicable. Booking organisers must communicate relevant entry requirements and conduct rules to their guests.

By purchasing a ticket, making a booking or paying a deposit, you accept the terms disclosed to you at the time of purchase. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

2 Bookings deposits and payment

A booking is confirmed once the required payment or deposit has been received and we have issued confirmation by email or SMS.

Please use your name and event date as the payment reference. You are responsible for providing accurate contact details, dates, addresses, access instructions and event requirements, and for advising us promptly of any changes.

Full payment must be received before the performance unless we have agreed otherwise in writing. We may withhold a performance where payment remains outstanding or where the venue, facilities or conditions are unsafe or unsuitable.

Where incorrect booking information or a failure to meet agreed requirements prevents delivery of the service, the customer cancellation policy below applies, subject to applicable consumer law.

Unpaid accounts may be referred for debt recovery. Where lawfully recoverable and disclosed as part of the booking agreement, reasonable recovery costs may be payable. Overdue amounts may attract interest at 13% per annum, calculated from the due date until payment, to the extent permitted by law.

3 Prices tickets and seating

Prices are quoted in Australian dollars and include GST unless clearly stated otherwise. Any additional charges will be disclosed before purchase. Prices may change before a booking is confirmed; confirmed prices will not change without your agreement.

Tickets, promotional offers and upgrades are subject to availability and the conditions disclosed at purchase.

General admission, complimentary tickets, Groupon offers and other promotional tickets may provide standing access only where stated in the offer. Reserved seating is included only where specified in your ticket or booking confirmation. Upgrades may be available for an additional charge.

4 Cancellations refunds and date changes 30-day policy

This section applies when you choose to cancel a ticket, private event, performer hire, full-show booking, Buy the Show package or venue or promoter booking, including because you change your mind or can no longer proceed.

  • 30 days or more before the event: Amounts paid will be refunded, less a $50 administration fee. The fee will not exceed the amount paid.
  • Fewer than 30 days before the event: No refund is available for tickets, deposits or other booking payments when you cancel.
  • Failure to attend: No refund is available for a missed event or performance.

Cancellation requests must be received in writing at info@menxclusive.com.au. Include your name, event date and booking or order number. The date we receive your request determines which cancellation period applies. A request received exactly 30 days before the event qualifies for the refund described above.

Date changes are subject to availability and our written agreement. A requested change does not automatically transfer your booking or extend the cancellation deadline. If we cannot accommodate the change and you cancel, the cancellation policy applies to the original event date.

Approved refunds will normally be returned using the original payment method. Where this is not possible, we will agree an appropriate alternative with you. A credit or voucher will not replace a refund required by law without your agreement.

This policy does not limit your rights under the Australian Consumer Law, including any entitlement to a refund or other remedy where we fail to provide the service as required by law. The $50 administration fee does not apply to refunds required because of such a failure.

5 Changes or cancellations by MenXclusive

Live performances may require changes to performers, running order, performance times or venue arrangements. We will make reasonable efforts to notify affected customers of significant changes.

If we cancel, postpone or materially change an event or booking, we will explain the available options. Any refund or other remedy will be provided in accordance with applicable consumer law. The customer cancellation cutoff does not remove those rights.

Arrival times for private bookings may be affected by traffic, weather or other unexpected delays. We will make reasonable efforts to arrive on time and advise you of significant delays. This does not exclude your rights if the service is not delivered as agreed.

6 Age identification and entry

All patrons and participants must be 18 years or older. Valid identification may be required before entry or participation. You must present a valid ticket or booking confirmation and pay any applicable entry charge.

Smart casual dress is required for club shows unless the event information states otherwise. Venue entry requirements also apply.

Entry may be refused, or a patron removed, for intoxication, suspected illicit drug use, unsafe behaviour, failure to meet age or identification requirements, or breaches of reasonable venue rules. Refund requests in these circumstances will be assessed under the booking terms and applicable law.

7 Respect safety and audience participation

We are committed to providing quality entertainment and a safe environment for our performers, staff and guests.

You must follow staff and performer instructions. Audience participation is voluntary. You must not touch a performer without their permission. Where a performer permits guided interaction, you must follow their directions and respect their boundaries at all times.

Violent, abusive, threatening, discriminatory, disruptive, offensive or illegal behaviour will not be tolerated. Serious breaches may result in removal, a venue ban or police involvement. Where removal results from your breach of these rules, no change-of-mind refund is available, subject to applicable law.

Please take reasonable care of your belongings and your own safety. Our responsibility for loss, damage or injury is determined by applicable law; these terms do not exclude liability that cannot lawfully be excluded.

8 Photography video and promotional media

Patron photography and video recording are not permitted unless we or the venue have authorised them.

We may photograph or film events for promotional purposes. Where filming is planned, we will provide appropriate notice. Please advise staff before the performance if you have concerns about appearing in promotional material, so we can discuss available arrangements.

Buying a ticket does not authorise us to use your personal information or image beyond what is permitted by applicable law. Any additional consent required will be obtained separately.

9 Questions and complaints

If you have a concern about your booking, seating or performance, please tell staff promptly so we have an opportunity to assist. You can also contact us on 0403 552 045 or at info@menxclusive.com.au.

Provide your booking details and a clear description of the issue. We will consider the circumstances and respond with any available resolution. Your statutory rights do not depend on raising a complaint before the event ends.

10 Website information and external links

We take reasonable care to keep website information accurate and current. Please contact us if you notice an error or need to confirm details before booking.

We do not guarantee uninterrupted website access or that the website will always be free of technical errors or harmful components. You should take reasonable precautions when accessing online content.

External links are provided for convenience. Unless expressly stated, they do not indicate endorsement. Third-party websites operate under their own terms and privacy policies.

Any limitation of our liability applies only to the extent permitted by law and does not exclude non-excludable consumer guarantees.

11 Copyright trademarks and confidential material

Our website content, branding and original promotional material are protected by intellectual property laws. Ownership remains with us or the relevant rights holder.

You may view, print or download website extracts for personal, non-commercial use. You must not reproduce, distribute, commercially exploit or republish protected content without permission or another lawful basis. Any permitted sharing must acknowledge the source.

Performances, choreography, costumes, music, photographs and production materials may also be protected. Their use, ownership and confidentiality are governed by applicable law and any separate written agreement with the relevant performer, contractor or rights holder. These website terms do not transfer ownership of third-party intellectual property to us.

Competitors and other businesses must not copy or commercially exploit our protected material without authorisation.

12 Changes to these terms and general provisions

We may update these terms from time to time. The terms disclosed when you purchase or confirm a booking apply to that transaction unless a lawful variation is agreed.

These terms, together with the booking confirmation and any expressly agreed written conditions, form the agreement for the relevant service. They do not override representations or rights protected by law.

If a provision is unlawful or unenforceable, it will be limited or removed to the extent necessary. The remaining provisions continue to apply.

13 Performer hire full-show bookings and Buy the Show packages

Booking scope and confirmation

These terms apply to private parties, hens nights, birthdays, corporate functions, club and theatre events, individual or group performer hire, full-show bookings and Buy the Show packages booked through us.

Your written quote and booking confirmation will identify the services included, event date, venue, performance duration, agreed fee, deposit, payment deadlines and any additional requirements. Only the services expressly included in the confirmed package are supplied. Any change to the agreed scope, duration, location or requirements must be agreed in writing, including any resulting price adjustment.

Buy the Show packages

A Buy the Show package is a booking of the agreed live production for your event. It does not transfer ownership of the show, branding, choreography, costumes, recordings or other intellectual property, or grant rights to reproduce or independently stage the production.

The written quote will state the package fee and whether travel, accommodation, transport, production equipment and other expenses are included. Any excluded costs and responsibility for arranging them must be agreed before confirmation. Additional costs require your agreement.

For a Buy the Show package, the venue or organiser retains ticket and bar revenue where this is included in the agreed offer. The booking confirmation must specify who manages ticket sales, ticket pricing, customer enquiries, ticket refunds, promotion and event administration. Any revenue-share or alternative arrangement must be expressly agreed in writing. Booking the show does not guarantee attendance, ticket sales or profitability.

Venue and organiser responsibilities

You must provide accurate event details and nominate an on-the-day contact. Before confirmation, tell us about access restrictions, venue rules and any proposed audience participation or special requests.

You are responsible for providing the venue access, performance space, safe facilities, changing area, power, sound, lighting and other equipment allocated to you in the agreed booking requirements. Setup, rehearsal and pack-down access must be provided as agreed. Any required technical specifications will be supplied or agreed as part of the booking.

Responsibility for permits, music licensing, security, insurance and other event approvals must be allocated in the booking confirmation. Each party remains responsible for its own legal obligations. The venue or organiser must comply with its obligations concerning capacity, alcohol service, audience safety and entry requirements.

Performer hire and performance delivery

Performer numbers, performance type, duration and any specifically agreed performer will be recorded in the booking confirmation. Special requests are included only if accepted by us in writing. You and your guests must follow the consent, conduct and safety rules in these terms.

Where an agreed performer becomes unavailable, we will notify you and discuss a suitable replacement or other available resolution. Any substitution or change remains subject to the confirmed booking terms and applicable consumer rights.

Performers may pause or stop a performance where there is a reasonable safety concern, harassment, inappropriate touching or another serious breach. We will explain the issue and, where safe and practicable, allow an opportunity to resolve it. Any refund or payment consequences will be assessed under these terms and applicable law.

Payments cancellations and event changes

The deposit and balance are payable by the deadlines stated in your quote or booking confirmation. A booking is confirmed only as described in section 2.

The 30-day customer cancellation policy in section 4 applies to performer hire, full-show bookings, Buy the Show packages and venue or promoter bookings. Cancellations received 30 days or more before the event qualify for a refund of amounts paid less the $50 administration fee. Customer cancellations received fewer than 30 days before the event do not qualify for a refund, subject to applicable law.

This cancellation policy concerns amounts already paid. It does not automatically make an unpaid balance payable on cancellation; any claim for additional cancellation costs must have a lawful basis under the agreed booking terms.

Date changes require our written agreement and are subject to availability. Low ticket sales or a change in your event plans do not automatically entitle you to a refund outside the customer cancellation policy. If we cancel or materially change the agreed service, section 5 and your applicable consumer rights apply.

The booking organiser is responsible for handling its own customers’ tickets in accordance with the ticketing arrangements and applicable law. Our refund policy for the organiser’s show booking does not determine the refund rights of those ticket holders.
